Waste Disposal Bayswater Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Disposal Bayswater provides waste disposal and waste collection services to domestic and commercial customers. By placing a booking, confirming an order, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

These terms apply to all services supplied by Waste Disposal Bayswater, whether arranged online, by telephone, by email, or in person. Please read them carefully before placing a booking for any waste removal or related service.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, organisation, or other party requesting or receiving services from Waste Disposal Bayswater.

Services means any waste collection, rubbish clearance, recycling, loading, transportation, or related services provided by Waste Disposal Bayswater.

Waste means any materials, items, rubbish, refuse, debris, or other goods to be collected, removed, transported, or disposed of as part of the Services.

Contract means the agreement formed between the Customer and Waste Disposal Bayswater when a booking is accepted in accordance with these Terms and Conditions.

Scope Of Services

Waste Disposal Bayswater provides waste collection, removal and disposal services for domestic and commercial customers, including but not limited to household rubbish removal, office waste clearance, bulky item disposal and general non-hazardous waste services. The specific scope of each service will be agreed with the Customer at the time of booking.

All services are carried out in accordance with applicable waste management regulations and environmental legislation. The Customer is responsible for accurately describing the Waste to be collected and for complying with all requirements stated in these Terms and Conditions.

Booking Process

To request Services, the Customer may contact Waste Disposal Bayswater by phone, email or through an online enquiry, providing details such as the type and estimated volume of Waste, access information, and any specific requirements relating to the collection.

Upon receiving an enquiry, Waste Disposal Bayswater will provide a quotation based on the information supplied by the Customer. Quotations are estimates only and are subject to change if the actual Waste or site conditions differ from those described by the Customer at the time of booking.

A booking is considered accepted and a Contract formed when the Customer confirms acceptance of the quotation and Waste Disposal Bayswater confirms the booking and service date. Confirmation may be given verbally or in writing, including email or other recorded communication.

The Customer must ensure that all information provided during the booking process is complete, accurate and up to date. Waste Disposal Bayswater is not responsible for any delay, additional cost or inability to provide the Services resulting from inaccurate or incomplete information provided by the Customer.

Service Access And Customer Obligations

The Customer must provide safe, reasonable and lawful access to the property or site at the agreed service time. This includes arranging any necessary permissions, parking, or access codes in advance. The Customer must ensure that the Waste to be collected is reasonably accessible and that any obstructions have been removed.

If our operatives are unable to access the property or Waste due to access restrictions, parking problems, or other issues beyond our reasonable control, we may charge a call-out fee or a proportion of the quoted service price to cover time and travel costs.

The Customer must ensure that the Waste presented for collection corresponds with the description provided during the booking and that any hazardous or prohibited materials have been removed where required. The Customer remains responsible for the Waste until it has been loaded onto our vehicle.

Payments And Pricing

All prices for Services will be provided to the Customer in the form of a quotation before the Contract is formed. Prices may be based on factors including, but not limited to, the type and volume of Waste, weight, labour required, access conditions and distance from the vehicle to the Waste.

Unless otherwise agreed in writing, payment is due immediately on completion of the Services. We accept a range of common payment methods, which will be communicated to the Customer at the time of booking or on completion of the work.

Where the actual volume or weight of Waste collected is greater than estimated by the Customer at the time of booking, or where additional labour or time is required due to site conditions, the final price may be adjusted accordingly. Any adjustment will be explained to the Customer before additional charges are incurred where reasonably practicable.

If payment is not received when due, Waste Disposal Bayswater reserves the right to charge interest on overdue amounts at the statutory rate applicable in England and Wales, from the due date until the date of payment in full.

Changes To Bookings

If the Customer wishes to change the date, time or scope of the Services after the booking has been confirmed, they must contact Waste Disposal Bayswater as soon as possible. Any change is subject to availability and may result in a revised quotation or additional charges.

Waste Disposal Bayswater will make reasonable efforts to accommodate changes requested by the Customer, but cannot guarantee that changes will be possible. Where a requested change cannot be accommodated, the original booking and terms will remain in place unless the Customer cancels the booking in accordance with the cancellation terms below.

Cancellations And Missed Appointments

The Customer may cancel a booking by giving Waste Disposal Bayswater notice. Where cancellation is received at least 24 hours before the agreed service time, no cancellation fee will normally be charged.

If the Customer cancels less than 24 hours before the agreed service time, or fails to provide access to the property or Waste when our operatives attend, Waste Disposal Bayswater reserves the right to charge a reasonable cancellation or call-out fee to cover the costs incurred.

Waste Disposal Bayswater may cancel or reschedule a booking due to reasons beyond its reasonable control, including but not limited to adverse weather, vehicle breakdown, staff illness, or safety concerns. In such circumstances, we will notify the Customer as soon as reasonably practicable and offer an alternative appointment. We will not be liable for any loss resulting from such cancellation or rescheduling, other than to refund any payment already made for Services that have not been provided.

Waste Types And Prohibited Items

Waste Disposal Bayswater will collect and dispose of general non-hazardous waste, including household rubbish, office waste, garden waste, and certain bulky items. The Customer must clearly identify the nature of the Waste at the time of booking and ensure it is correctly sorted where necessary.

We do not accept hazardous or controlled waste unless explicitly agreed in writing in advance and subject to specific terms and pricing. Hazardous waste may include, but is not limited to, asbestos, chemicals, solvents, oils, clinical waste, gas cylinders, certain electrical items and other regulated materials.

If hazardous or prohibited items are discovered among the Waste at the point of collection, Waste Disposal Bayswater may refuse to collect such items, amend the quotation to reflect specialist handling and disposal costs, or cancel the Service in whole or in part. The Customer may be charged a reasonable fee for time spent on site and any associated costs.

Compliance With Waste Regulations

Waste Disposal Bayswater operates in accordance with applicable UK waste management and environmental legislation. We aim to handle, transport and dispose of all Waste in a manner that complies with statutory requirements and promotes responsible waste disposal practices.

Once Waste has been loaded onto our vehicle, it becomes our responsibility and we will ensure it is transferred to appropriately licensed facilities or managed in compliance with relevant regulations. Where required, appropriate documentation or receipts relating to waste transfer may be made available to the Customer.

The Customer is responsible for ensuring that any Waste presented for collection has been lawfully accumulated and stored and that no laws or regulations are breached by its removal. The Customer must not request that Waste Disposal Bayswater handle or dispose of Waste in any manner that would contravene applicable legal or environmental obligations.

Customer Property And Site Condition

The Customer must ensure that the site is safe for our operatives and that any known hazards are disclosed at the time of booking or as soon as they become apparent. This includes structural concerns, dangerous materials, aggressive animals or any other risks to health and safety.

While Waste Disposal Bayswater will take reasonable care when carrying out the Services, the Customer acknowledges that the nature of waste collection may involve movement of heavy or bulky items and work in confined or cluttered spaces. The Customer should remove any valuables or fragile items from the vicinity of the work area before the Services commence.

Waste Disposal Bayswater will not be liable for minor damage to floors, walls, fixtures or landscaping reasonably arising from the normal performance of the Services where adequate care has been taken. The Customer should notify us immediately of any alleged damage so that we may investigate.

Liability And Limitations

Nothing in these Terms and Conditions shall limit or exclude Waste Disposal Bayswater's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

Subject to the above, Waste Disposal Bayswater shall not be liable for any indirect, consequential or purely economic loss, including but not limited to loss of profit, loss of business, loss of data, or loss of opportunity arising out of or in connection with the Services or these Terms and Conditions.

Waste Disposal Bayswater's total aggregate liability to the Customer arising out of or in connection with any Contract shall, to the fullest extent permitted by law, be limited to the total price paid or payable by the Customer for the particular Services giving rise to the claim.

The Customer shall be responsible for and shall indemnify Waste Disposal Bayswater against all claims, costs, damages, losses and expenses arising from any breach by the Customer of these Terms and Conditions or any failure by the Customer to comply with applicable law in relation to the Waste or the property.

Delays And Events Beyond Our Control

Waste Disposal Bayswater will use reasonable efforts to carry out the Services at the agreed time. However, time shall not be of the essence and we shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events or circumstances beyond our reasonable control.

Events beyond our control may include, without limitation, adverse weather, traffic congestion, accidents, breakdowns, industrial disputes, public events, road closures, or actions of third parties. In such cases, we will endeavour to inform the Customer of any delay and rearrange the Services where appropriate.

Insurance

Waste Disposal Bayswater maintains appropriate insurance cover in respect of its operations, including public liability insurance. Details of our insurance cover can be made available to Customers upon reasonable request.

Data Protection And Privacy

Waste Disposal Bayswater collects and processes personal information about Customers as necessary to arrange and deliver the Services, handle payments, and manage customer relationships. We will handle such information in accordance with applicable data protection legislation.

Personal data provided by the Customer will be used only for legitimate business purposes, including administration of bookings, provision of Services, handling of queries or complaints, and compliance with legal obligations. We will take reasonable steps to keep personal data secure and to prevent unauthorised access or disclosure.

Complaints And Disputes

If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Disposal Bayswater as soon as possible, providing details of the issue and any relevant evidence. We will investigate complaints promptly and aim to resolve them fairly.

Where a dispute cannot be resolved directly between the parties, either party may consider seeking independent advice or using an appropriate dispute resolution process. Nothing in this clause affects the statutory rights of consumers.

Amendments To These Terms

Waste Disposal Bayswater may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to the relevant Contract. Updated terms may be made available through our usual communication channels.

Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.

Governing Law And Jurisdiction

These Terms and Conditions, and any Contract between the Customer and Waste Disposal Bayswater, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or any Contract formed between the Customer and Waste Disposal Bayswater.

By placing a booking for waste disposal or waste collection services with Waste Disposal Bayswater, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
